These terms of service (draft) apply to the use of Bayana, a SaaS platform for member administration. The text has not yet been legally reviewed and may change.
Scope
These terms apply to every organisation that creates an account with Bayana and to the users who are given access on behalf of that organisation.
Service description
Bayana provides a multi-tenant SaaS platform for member administration: member management, contribution management, automated bank import with human confirmation, SEPA direct debit, a member portal, communication and export.
Subscriptions and pricing
Bayana offers a tiered set of subscriptions (including a free starter plan) with different features and limits, as described on the pricing page. Current rates always apply; changes are communicated in advance.
Payments
Subscription payments are handled by an external payment provider (Mollie or Stripe). Bayana does not itself store full payment details.
Organisation responsibilities
The organisation is responsible for the accuracy of the data it enters and for correct use of the platform, including not entering a national ID number or other data not needed for member administration.
Availability
Bayana aims for a reliable service but, at this draft stage, offers no formal availability guarantee (SLA). Planned maintenance is announced in advance where possible.
Liability
Bayana's liability is, to the extent legally permitted, limited. The final liability provisions will be established after legal review of these draft terms.
Termination and data export
An organisation may cancel its subscription; data remains exportable until final deletion after the retention period.
Changes to these terms
These terms may change, including after legal review. Material changes will be communicated in advance.
Governing law
These terms are governed by the laws of the Netherlands.
